As an Executor or Administrator, you may find yourself faced with a claim against you, the Will or the way you are managing the Estate.
One way this may happen is in the form of a Caveat for example; stopping the probate process until specific issues are resolved. We would recommend talking to an independent Legal Adviser as soon as possible if this occurs. Some claims against Executors can be on the basis of the validity of the Will which in turn could reflect on the original Will writer so it is advisable to use somebody different to help you defend a claim against you so there is no conflict of interest.
Due to the small initial cost involved and people acting on their own without legal advice, sometimes Caveats can be issued incorrectly so it is wise to check with a Solicitor before reacting in any way.
Also before accepting the role of Executor or Administrator you might investigate insurance to cover your actions in the role. There are specific policies available. Remember, should anything go wrong you could be personally liable.
We would always recommend a quick no obligation conversation with one of our Legal Advisers to see what they think your position might be and how they might be able to help you.
